Police Minister Nathi Nhleko has argued a previous judgment relied on to deem his appointment of Hawks head Berning Ntlemeza invalid is flawed. Leave to appeal against the previous judgment was not granted by the high court but Nhleko is adamant the judgment in that matter is flawed as the court did not have jurisdiction in the matter. The judgment was in the case brought by former Gauteng Hawks boss Shadrack Sibiya in which his suspension, linked to the rendition of Zimbabwean nationals, was declared invalid. In that judgment Judge Elias Matojane deemed Ntlemeza as dishonest and as lacking integrity. The minister has applied for leave to appeal to the Supreme Court in this matter.
