Mxolisi Nxasana had requested to leave office as national director of public prosecutions (NDPP), "because the President said so". Advocate Ishmael Semenya SC, for President Jacob Zuma, told the High Court in Pretoria on Tuesday that the President’s version of Nxasana having requested to leave office, was uncontested on that point. He was arguing in the application by lobby groups to have Nxasana’s 2015 R17m settlement reviewed and set aside. On Monday the court denied Nxasana’s application for condonation with costs, after the former prosecutions head had asked the court to admit his affidavit, which was filed more than a year late. In it he accuses the President of lying. Zuma’s version is therefore not contradicted by Nxasana’s. This is a crucial point in the matter, as there are limited ways in which an NDPP can leave office before the expiration of the 10-year term of office. The applicants in the matter contend that documentary evidence does not support the Zuma’s version. But...
