The High Court in Cape Town has dismissed Dave Woollam’s case against four directors of Lewis Group, describing it as frivolous, vexatious and without merit. Judge Ashley Binns-Ward also awarded costs against Woollam, a director of Summit Financial Partners. The Lewis Group welcomed the judgment setting aside Woollam’s bid to have four of its directors declared delinquent. The four directors are CEO Johan Enslin, chief financial officer Les Davies, chairman David Nurek and head of the audit committee Hilton Saven. Clark Gardner, CEO at Summit Financial Partners, said he was "extremely disappointed" by the court’s decision, describing it as a "disincentive to future action by corporate stakeholders". A statement issued by the Lewis Group said that according to the judgment, Woollam could not prove the directors had been responsible for the sale of insurance for loss of employment, which the company said was due to erroneous data capture.
