The Minerals Council SA has filed an application for judicial review challenging parts of the recently gazetted Mining Charter. The council, which says the decision to approach the courts was taken reluctantly, has highlighted that clauses, particularly around black ownership, do not sufficiently recognise past deals. The council’s senior executive of public affairs and transformation, Tebello Chabana, joined Business Day TV to discuss the reasons for approaching the courts and the outcome they would like to see.
