The DA is mounting a court fight against SA’s decision to withdraw from the International Criminal Court (ICC). The DA will on Friday approach the courts to have the notice of SA’s intention to withdraw from ICC “set aside on the grounds that it is unconstitutional‚ irrational and procedurally flawed”. Justice Minister Michael Masutha confirmed the decision on Friday morning, saying the implementation of the Rome Statute of the International Criminal Court Act hindered SA’s relations with foreign countries‚ particularly with those where serious conflicts occurred. The issue of SA’s membership of the ICC first arose when SA failed to arrest Sudanese President Omar al-Bashir when he was in SA last year. “This act and the Rome Statute of the ICC compel SA to arrest to arrest persons who may enjoy diplomatic immunity under customary international law‚ but who are wanted by the ICC for genocide‚ crimes against humanity and war crimes and to surrender such persons to the ICC‚” Masutha sai...
