The argy-bargy about the terms of reference in the long-awaited state capture inquiry is a diversion. That’s because the terms of reference are basically set, and overwhelming evidence of state capture — thanks in part to the cascade of leaked Gupta e-mails — is readily available. The Pretoria high court judgment that ordered President Jacob Zuma to set up a judicial commission of inquiry into state capture headed by a judge selected by chief justice Mogoeng Mogoeng, found that the remedial action in former public protector Thuli Madonsela’s report was broad enough to encompass the revelations contained in the Gupta e-mails. These came to light only after the release of Madonsela’s "State of Capture" report. The e-mails are full of correspondence between government officials, directors of state-owned enterprises, private sector companies and the Guptas, and amount to prima facie evidence of corruption.
