It is disturbing that those ANC caucus members who voted for the motion of no confidence in President Jacob Zuma are being threatened with disciplinary proceedings. Surely, the ANC is sufficiently well-advised to know that, given the Constitutional Court judgment on the matter, there is no prospect of successfully disciplining those who voted their conscience? Even if the ANC constitution says what Zuma suggests it does, which is doubtful, it is trumped by the country’s Constitution and the rule of law. Those under threat should consider going on the front foot and interdicting the ANC structures from bringing the threatened disciplinary procedures. This step might be a good lesson for the ANC in the basics of constitutionalism: conduct inconsistent with the Constitution, as the disciplinary proceedings indubitably would be, is invalid.
