THE Cabinet has demanded that the SABC abide by a Supreme Court of Appeal ruling and stop disrespecting the rule of law. On Tuesday the national broadcaster ignored both the public protector and the courts by reappointing its controversial former chief operating officer Hlaudi Motsoeneng as group executive responsible for corporate affairs. The SABC said Motsoeneng was free to apply for the chief operating officer position once it was advertised. The Supreme Court of Appeal last week dismissed the SABC’s leave to appeal application of a High Court in Cape Town judgment setting aside Motsoeneng’s appointment. Minister in the Presidency Jeff Radebe said after a Cabinet meeting: "Attempts to subvert the Supreme Court of Appeal ruling through legally suspect interpretations border on violating the constitutional principle of legality and challenge the constitutionality assigned judicial authority of our courts."
