The SA Human Rights Commission (HRC) does not have the power to make “binding” directives against alleged violators of basic rights, despite it being a chapter 9 institution.
This was the finding of the Supreme Court of Appeal (SCA), after the HRC fought to have its directives made “binding” on a farmer, who “unilaterally introduced [water] restrictions” on families living on his farm...
