Allegations about Jiba’s qualifications were untested at inquiry, say lawyers
Inquiry told that to portray suspended deputy NPA boss as guilty without hearing her version is procedurally incorrect
It is grossly unfair and procedurally incorrect to portray Nomgcobo Jiba as dishonest or guilty of misconduct about her qualifications without hearing her version on the allegations, according to a written note submitted by her lawyers. The note was submitted to the inquiry by Adv Norman Arendse SC, Thabani Masuku SC and Shaun Fergus and was dated March 8 2019. They were responding to allegations made in written submissions by the Mokgoro inquiry’s evidence leaders that Jiba had referred to herself as an advocate long before she was appointed one. The inquiry, chaired by retired Constitutional Court judge Justice Yvonne Mokgoro, was set up by President Cyril Ramaphosa to look into Jiba, the deputy national director of public prosecutions and the head of the commercial crimes unit Lawrence Mrwebi’s fitness to hold office.
