The SA judiciary can sometimes be affected by problems faced by judges in neighbouring states. Take, for instance, the case of Lesotho’s appeal court president, Kananelo Mosito, who faces possible impeachment, with a tribunal investigating his fitness for office because of alleged nonfiling of tax returns since 1996. Quite properly, no judge from Lesotho has been involved in the tribunal — it would put local judges in an invidious position if they had to decide whether to recommend impeachment of their country’s top judicial officer. Instead, three retired SA judges were asked to help out: judge Fritz Brand, who chaired the tribunal, and judges John Foxcroft and Neville Hurt. It has been a fraught business, with Mosito using numerous legal points to delay or frustrate the hearings.
