Deputy National Director of Public Prosecutions Nomgcobo Jiba will approach the Supreme Court of Appeal (SCA) in a bid to have a high court order that she be struck off the advocates roll overturned. On Monday, the High Court in Pretoria granted her application for leave to appeal against its judgment in September 2016. If the appeal court agrees with the high court order, Jiba will be disqualified from her post at the National Prosecuting Authority (NPA). According to the NPA Act, to remain in her post Jiba must “possess legal qualifications that would entitle her to practise in all courts in the Republic” — in other words, be either an advocate or an attorney. “The next step is for us to file the full grounds for appeal to the SCA which is something we [are] hoping to do very shortly,” her lawyer Zola Majavu said. “The judges will then give us [a] directive.” It could take up to a year for the matter to be concluded.
